- A contract policy. This document provides a framework for contracts within your business. It deals with how contracts must be requested, drafted, reviewed, negotiated, approved, signed and stored within your company. For example, the policy can provide that contracts should not be signed without sign off from legal (internal or external).
- Legal risk reports. Formulating legal risk reports for each contract signed within your business. The legal risk report highlights legal and commercial risks identified in a particular contract and informs the reader how the risks identified were mitigated. The legal risk report will then be signed by legal and the relevant business unit stakeholder. The idea behind this is to allow for transparency and provide evidence of legal position adopted for future reference purposes.
- A contract checklist. It lists clauses contained in your internal business agreements, the purpose behind them and your company policy.
- Contract strategy.
- A dedicate attorney for your business, whether as external legal counsel or internal. You can also explore different fee structure if there is no budget or there is a limited budget for legal services in your business. See legal services as an investment rather than an expense. Find out from your accountant if you can claim legal costs as a tax deduction.
